Frequently Asked Questions

Who can get married in Spain?

+

To get legally married in Spain, you must have a proof of residency at least 2 years prior to your wedding application. For this reason, Non-Spanish couples often choose to have a legal wedding in their own country and come to Spain for the religious or symbolic venue. Same-sex civil unions have been officially recognised as of 2005. Couples must be 18 years old to legally marry, and under-18s must have written parental consent.

What kind of wedding can I have in Spain?

+

If you would like to have the legal ceremony in Spain, there are typically three types of wedding ceremonies you can have:

1. Civil Ceremony: Performed in the Civil Registry office or in the local town hall. Civil ceremonies are only possible if at least one of the marrying couple is a Spanish citizen, or at least one of you meets the 2 year residency requirement.

2. Religious Ceremony. Performed by the local priest in a church setting and does not require a civil ceremony beforehand. Instead, you need to obtain a locally registered marriage certificate. Catholic, Jewish, Islamic and Protestant ceremonies are legally recognized in Spain.

3. Symbolic Ceremony: A humanist wedding does not require any legal documents and is not legally binding. Instead, you have the freedom to personalise the ceremony to reflect your values and beliefs. Due to the residency requirements, expats commonly choose to have their legal ceremony in their country of residence and fly to Spain for the celebrations. This is the quickest and easiest approach for a wedding abroad.

What documentation is needed to get married in Spain?

+

The quickest and easiest approach for a wedding abroad is to have the legal ceremony in your country of residence and fly to France for the celebrations and host a “symbolic-style” ceremony.

However, if you would like to process the legal paperwork in Spain, Europeans & UK citizens require the following for a civil ceremony.

1. Proof of residency in Spain for at least 2 years prior to the application, for at least one of the parties

2. Certificate of Non Impediment: A certificate you receive from your local counsel, stating you are free to marry. This is also known as a CNI. Each person in the couple requires one and is valid for three months.

3. A valid passport

4. Original birth certificate

5. Proof any previous marriages have ended (Divorce Decree or Death Certificate)

*all the above must be translated into Spanish by a translator authorised by the Spanish Embassy.

What is the process to get married in Spain?

+

The quickest and easiest approach for a wedding abroad is to have the legal ceremony in your country of residence and fly to France for the celebrations and host a “symbolic-style” ceremony.

However, if you would like to process the legal paperwork in Spain, you will need to be slightly more organised (or get support from a local planner!). For European citizens, it is often recommended to contact the local Spanish town hall 6-12 months before your ideal wedding date to find out about local civil partnership laws, including what documents you and your partner will need.

Typically, you must bring your translated documents (stamped with an Apostille) to the local Town Hall and apply for permission to marry (Certificado de Capacidad Matrimonial). This triggers a public announcement of your intent to marry on the Consular notice board for 15-21 days. After 10 days, you should schedule your marriage interview date (Spain ensures you are genuine applicants!). After this, the Office of the Registrar will issue your marriage license. This process can take between 30-50 days.

You are required to have 2 witnesses and 1 interpreter during the ceremony. At the end of the ceremony, your marriage is effective immediately and you will receive a certificate stating the date, time, and place of the wedding.

What is the quickest & easiest way to get married in Spain?

+

The quickest and easiest approach for a wedding abroad is to have the legal ceremony in your country of residence and fly to Spain for the celebrations for a “symbolic-style” ceremony. This means that you do not need to worry about sharing, translating or completing additional documents for a civil or religious ceremony as you are already legally married. When you come to Spain, you can celebrate your commitment to one another and personalise the ceremony in a way that reflects your values and beliefs (personal vows, favorite songs, poetry, gift exchanges, religious elements etc).
